| Abstract: | Статья посвящена вопросам правового регулирования судебного разбирательства, осуществляемого в отношении умершего подсудимого. Обращается внимание на отсутствие необходимых правовых норм, регламентирующих порядок производства по уголовному делу, а также участия представителя умершего подсудимого в судебном разбирательстве. На основе анализа судебной практики делается вывод о необходимости внесения изменений в Уголовно-процессуальный кодекс Российской Федерации в части регламентации порядка рассмотрения судом уголовного дела в отношении умершего подсудимого. |
| Abstract (in another language): | The article is devoted to the issues of legal regulation of judicial proceedings carried out in relation to the deceased defendant. Attention is drawn to the absence of the necessary legal norms regulating the procedure of criminal proceedings, as well as the participation of the representative of the deceased defendant in the trial. Based on the analysis of judicial practice, it is concluded that it is necessary to amend the Code of Criminal Procedure of the Russian Federation regarding the regulation of the procedure for consideration by the court of a criminal case against a deceased defendant |
