| Abstract: | Среди принципов права интеллектуальной собственности, называемых учеными, единодушно выделяется принцип баланса интересов обладателя исключительного права на объекты интеллектуальной собственности и интересов общества. Его реализация осуществляется посредством установления ограничений и исключений в отношении исключительного права. При отсутствии сомнений в их необходимости не наблюдается единства мнений по определению их количества, содержания и непосредственного формулирования. В качестве основных проблем реализации данного принципа указываются определение той степени ограничений исключительного права, которая будет создавать искомый баланс, а также отсутствие какой-либо системности и низкая степень последовательности при их закреплении |
| Abstract (in another language): | Among the principles of intellectual property law, called by scientists, the principle of balancing the interests of the owner of the exclusive right to intellectual property objects and the interests of society is unanimously singled out. Its implementation is carried out through the establishment of restrictions and exceptions with respect to the exclusive right. If there is no doubt about their necessity, there is no consensus on determining their number, content and direct formulation. The main problems of the implementation of this principle are the determination of the degree of restrictions of the exclusive right that will create the desired balance, as well as the lack of any system and a low degree of consistency in their consolidation |
