| dc.description.abstract | Среди принципов права интеллектуальной собственности, называемых учеными, единодушно выделяется принцип баланса интересов обладателя исключительного права на объекты интеллектуальной собственности и интересов общества. Его реализация осуществляется посредством установления ограничений и исключений в отношении исключительного права. При отсутствии сомнений в их необходимости не наблюдается единства мнений по определению их количества, содержания и непосредственного формулирования. В качестве основных проблем реализации данного принципа указываются определение той степени ограничений исключительного права, которая будет создавать искомый баланс, а также отсутствие какой-либо системности и низкая степень последовательности при их закреплении | |
