| Abstract: | В работе демонстрируется два принципиально разных подхода к вопросу правомерности санкций: помимо теоретической дискуссии об общей правомерности санкций, мы рассматриваем правомерность отдельных мер к ним относящихся. Также оценивается положение санкций в контексте фрагментации международного права, в особенности – в рамках права прав человека. Исследование позволяет взглянуть на проблему санкций с другого ракурса, но не теряет основной направленности: определить правомерность их применения в соответствии с современным международным правом |
| Abstract (in another language): | The abstract demonstrates two fundamentally different approaches to the question of the legality of sanctions: in addition to the theoretical discussion of the general legality of sanctions, we consider the legality of individual measures related to them. It also assesses the position of sanctions in the context of the fragmentation of international law, especially within the framework of international human rights law. The study allows us to look at the problem of sanctions from a different angle, but does not lose the main focus: to determine the legality of their application in accordance with modern international law |
