| Abstract: | Статья посвящена исследованию особенностей субсидиарной ответственности поручителя, имеющей договорный характер. В статье на основании анализа правоприменительной практики рассмотрены некоторые аспекты объема, сроков возмещения и правовых последствий исполнения обязательств поручителем. Установлено, что последствием исполнения поручителем обязательства за должника является не регресс, а суброгация. Предложены соответствующие изменения в ст. 399 ГК РФ. |
| Abstract (in another language): | The article is devoted to the study of the features of the subsidiary liability of the guarantor, which has a contractual nature. In the article, based on the analysis of law enforcement practice, some aspects of the volume, terms of compensation and the legal consequences of the fulfillment of obligations by the guarantor are considered. It has been established that the consequence of the fulfillment by the guarantor of an obligation for the debtor is not regress, but subrogation. Corresponding amendments to Article 399 of the Civil Code of the Russian Federation are proposed. |
