| Abstract: | В статье анализируются новеллы по вопросам применения медиации, внесенные в хозяйственное процессуальное законодательство. Автор обосновывает, что применение медиации по экономическим спорам следует допускать только в суде первой инстанции, а также в суде апелляционной инстанции, когда суд апелляционной инстанции рассматривает дело по правилам, установленным для суда первой инстанции; применение медиации допустимо лишь на основании соглашения сторон спора о применении медиации, а не абсолютного любого соглашения; суд не полномочен передавать спор для урегулирования с участием медиатора, осуществить такую передачу вправе только стороны конфликта. Сделанные в статье выводы сопровождаются предложениями по совершенствованию действующего законодательства. |
| Abstract (in another language): | The article analyzes the novelties introduced into the economic procedural legislation on the use of mediation. The author argues that the use of mediation in economic disputes should be allowed only in the court of first instance, as well as in the court of appeal, when the court of appeal is considering the case according to the rules established for the court of first instance; the use of mediation is permissible only on the basis of the agreement of the parties to the dispute on the use of mediation, and not any absolute agreement; the court is not empowered to transfer a dispute for settlement with the participation of a mediator. Only the parties to the conflict have the right to make such a transfer. The conclusions made in the article are accompanied by proposals for improving the current legislation. |
