| Abstract: | Настоящая статья посвящена анализу особенностей и проблем, сложившихся в правоотношениях между супругами и кредитными организациями в спорах о разделе долговых обязательств. Используя судебную практику судов Тверской области, а также обращаясь к международному праву, автор статьи выявляет не только трудности, но и положительные моменты, с которыми сталкиваются кредитные учреждения и супружеские пары ввиду необходимости защитить себя друг от друга в спорах о разделе долговых обязательств. На основе проведенного исследования предлагаются определенные пути решения вопросов защиты прав супругов перед кредитными организациями в рамках раздела долгов, позволяющие обезопасить как самих кредиторов, так и супругов |
| Abstract (in another language): | This article is devoted to the analysis of the peculiarities and problems that have developed in legal relations between spouses and credit institutions in disputes over the division of debt obligations. Using the jurisprudence of the courts of the Tver region, as well as referring to international law, the author of the article identifies not only difficulties, but also positive aspects that credit institutions and married couples face in view of the need to protect themselves from each other in disputes over the division of debt obligations. On the basis of the study, certain ways of solving the issues of protecting the rights of spouses to credit organizations within the framework of the division of debts are proposed, which allow protecting the rights of both creditors and spouses |
