Уничтожение под таможенным контролем как наиболее эффективный способ борьбы с контрафактом

Abstract

Статья посвящена анализу законодательства по применению процедуры уничтожения контрафактной продукции таможенными органами. Автором раскрыто понятие контрафактной продукции и механизм приостановления таможенного оформления товаров, подозреваемых в нарушении прав интеллектуальной собственности. В статье рассмотрены акты международного характера по названной тематике и проведено их соотношение с законодательством и таможенной практикой Республики Беларусь. Автором изложены основания для применения процедуры уничтожения контрафакта таможенными органами (на примере стран ЕС, стран Таможенного союза и Республики Беларусь), полномочия органов и лиц на принятие соответствующего решения, порядок проведения процедуры уничтожения и обозначены проблемы введения упрощенных процедур уничтожения поддельной продукции в Республике Беларусь. = The article is devoted to the analysis of the legislation on the procedure of the customs destruction of counterfeit goods. The author reveals the defi nition of counterfeit goods and the mechanism for suspending the release of goods suspected of violation of the intellectual property rights. The article examines international acts on the abovementioned issues and correlates them with Belarusian legislation and customs practice. The author describes the reasons for using the procedure of destruction of counterfeit goods by customs (taking as an example the rules of the EU, Member States of the Customs Union and the Republic of Belarus), institutional and personal authority to make the appropriate decision and the destruction procedure, as well as identifi es the problems of introduction of simplifi ed destruction procedures for the goods violating the intellectual property right in the Republic of Belarus.
