Особенности компьютерного программного обеспечения как объекта интеллектуальной собственности

Abstract

Статья посвящена анализу основных особенностей компьютерной программы как объекта права интеллектуальной собственности. Автором исследуются исторические этапы закрепления за компьютерными программами правовой охраны на международном уровне. В статье рассматриваются особенности авторского законодательства Республики Беларусь в отношении компьютерных программ. Кроме того, основываясь на зарубежной практике, автор изучает возможность и целесообразность дополнительной охраны нормами патентного права. В данной работе также затронуты проблемы защиты компьютерных программ и способы их решения. = The article is devoted to the analysis of the major peculiarities of the computer program as an object of intellectual property right. The author examines the basic historic steps of computer programs evolution into internationally recognized object of legal protection. The article includes the peculiarities of the copyright legislation of Belarus consideration in respect of computer programs. Furthermore the author, basing on the foreign experience, studies possibility and reasonability of additional protection by the means of patent law. This research also applies to the problem of the legal enforcement and the ways of its solving.
