Abstract

The article considers the peculiarities of exercising discretionary power of the court. The forms of expressing discretionary power of the court are revealed: namely, the direct indication in the law of the possibility of the discretion of the court, the presence of dispositive legal norms in law, the necessity of applying legal norms containing evaluation concepts, the use of law analogy. = Рассмотрены особенности реализации дискреционной власти суда и выявлены формы ее выражения: прямое указание в законе на возможность усмотрения суда; наличие в законе диспозитивных норм права; необходимость применения норм права, содержащих оценочные понятия; использование аналогии закона и аналогии права.
