| Abstract: | В статье рассмотрены наиболее существенные изменения и дополнения Конституции Республики Беларусь 1994 года в редакции 2022 года, касающиеся системы конституционных обязанностей и концепции конституционного контроля в контексте влияния на их развитие базовых конституционных и национальных ценностей белорусского общества и государства. Автор дифференцирует систему юридических обязанностей субъектов конституционных правоотношений, классифицируя их по различным основаниям: источникам закрепления, субъектному составу, срокам реализации и сферам применения. Особое внимание автор уделяет категории «долг», ее месту, роли, значению и соотношению с понятиями «конституционная обязанность» и «конституционная ответственность». В результате исследования новых полномочий Конституционного суда РБ в сфере конституционного контроля автором сформулированы предложения, дополняющие закон «О Национальном собрании Республики Беларусь» в части определения понятия и перечня грубых нарушений Палатами Парламента РБ Конституции. |
| Abstract (in another language): | The article examines the most significant changes and additions to the 1994 Constitution of the Republic of Belarus as amended in 2022, concerning the system of constitutional duties and the concept of constitutional control in the context of the influence on their development of the basic constitutional and national values of the Belarusian society and state. The author differentiates the system of legal responsibilities of subjects of constitutional legal relations, classifying them on various grounds: sources of consolidation, subject composition, deadlines for implementation and areas of application. The author pays special attention to the category “duty”, its place, role, meaning and correlation with the concepts of “constitutional duty” and “constitutional responsibility”. As a result of the study of the new powers of the Constitutional Court of the Republic of Belarus in the field of constitutional control, the author formulated proposals that supplement the law “Of the National Assembly of the Republic of Belarus” in terms of defining the concept and list of gross violations of the Constitution by the Chambers of the Parliament of the Republic of Belarus. |
