| Abstract: | Анализируются основные признаки земельного правонарушения. Особое внимание уделяется та кому признаку земельного правонарушения, как противоправность, а также проблемам разграничения правомерного и противоправного поведения субъектов земельных отношений, в том числе в случаях несовпадения юридической и фактической границы земельного участка. Обоснованы предложения по совершенствованию земельного законодательства Республики Беларусь в части легализации нарушений земельного законодательства, уточнения обязанностей землепользователей по использованию земельных участков и разграничения смежных составов земельных правонарушений. |
| Abstract (in another language): | The main features of land offenses are analysed in the article. Particular attention is paid to such a feature of land offenses as illegality, as well as to the problems of distinguishing between lawful and illegal behaviour of subjects of land relations, including the cases of discrepancy between the legal and actual boundaries of a land plot. Proposals for improving land legislation of the Republic of Belarus in terms of legalisation of land offenses, clarification of the obligations of land users to use land plots and differentiation of related types of land offenses are substantiated. |
