| Abstract: | В статье рассмотрена проблема определения применимого права к спорам с иностранным инвестором. Акцентируется внимание на последствиях данной проблемы, что отражается на процессуальном поведении инвестора в спорах с государством-реципиентом инвестиций. Также выявлен доктринальный подход к вопросу о том, каким образом инструменты международного частного права призваны положить начало решению рассматриваемой проблемы |
| Abstract (in another language): | The article considers the problem of determining the applicable law to disputes with a foreign investor. Attention is focused on the consequences of this problem, which is reflected in the procedural behavior of the investor in disputes with the recipient state of investments. The doctrinal approach to the issue of how the instruments of international private law are intended to initiate the solution of the problem under consideration is also revealed |
