| Abstract: | Авторы анализируют развитие института «обход закона» в международном частном праве. Рассматриваются стадии развития и подходы к определению данного понятия. Анализируется значение института «обход закона» в странах романо-германской и англо-саксонской правовых систем. Устанавливается, что закрепление института на законодательном уровне в странах континентального права положительно повлияет на предупреждение действий в обход закона |
| Abstract (in another language): | The authors analyze the development of the institution of "circumvention of the law" in international private law. The stages of development and approaches to the definition of this concept are considered. The significance of the institution of "circumvention of the law" in the countries of the Romano-Germanic and Anglo-Saxon legal systems is analyzed. It is established that the consolidation of the institution at the legislative level in the countries of continental law will have a positive effect on the prevention of actions in circumvention of the law |
