| Abstract: | В статье анализируется соотношение таких юридических категорий как «судебная власть», «правоохранительные органы» и «правосудие». Как известно, правоохранительную функцию государства реализуют органы законодательной, исполнительной и судебной власти. Суды осуществляют функцию правосудия. Автор приходит к выводу, что для реализации функции правосудия суды наделены компетенцией (правами и обязанностями). А при рассмотрении конкретных дел суд осуществляет функцию правосудия в пределах своей компетенции. |
| Abstract (in another language): | The article analyzes the relationship between such legal categories as «judicial power», «law enforcement agencies» and «justice». As is known, the law enforcement function of the State is carried out by the legislative, executive and judicial authorities. Courts exercise the function of justice. The author comes to the conclusion that to implement the function of justice, courts are endowed with competence (rights and duties). And when considering particular case, the court exercises the function of justice within its competence. |
