| Abstract: | В статье рассматриваются теоретические и практические проблемы судебно-прокурорско-следственной практики, связанные с вопросами квалификации преступлений по ст. 430, 433 УК, проблемы переквалификации преступлений, связанные с субъектом указанных преступлений. В статье проанализирована судебная практика рассмотрения уголовных дел по вопросу отнесения действий к полномочиям должностного лица. Дано разграничение полномочий субъектов преступлений, предусмотренных ст. 430 и 433 УК. |
| Abstract (in another language): | This article discusses the theoretical and practical problems of judicial-prosecutorial-investigative practice related to the issues of qualification of crimes under Articles 430, 433 of the Criminal Code, regarding the powers of an official, the problems of re-qualification of crimes related to the subject of these crimes. The article examines the judicial practice of considering criminal cases, where there are many difficulties in attributing certain actions to the powers of an official or an employee of a state body, or another state organization that is not an official. The analysis delineates the powers of the subjects of crimes provided for in Articles 430 and 433 of the Criminal Code. |
