| Abstract: | Статья посвящена анализу правовых норм, определяющих состав земель водного фонда Республики Беларусь. Отмечается, что правовой режим данной категории земель усложнился после существенного обновления земельного законодательства. Автор указывает на несогласованность терминологии земельного и водного законодательства при определении состава земель водного фонда и анализирует вызванные этим противоречия в правовом регулировании. Предлагается уточнить виды земель, земельных участков, которые соответствуют признакам земель водного фонда с учетом дополнительных критериев их выделения. Автором сформулированы научные и практические выводы по совершенствованию состава земель водного фонда и правового регулирования их использования. |
| Abstract (in another language): | The article is devoted to the analysis of legal norms defining the composition of lands of the water fund of the Republic of Belarus. It is noted that the legal regime of this category of land has become more complicated after a significant update of land legislation. The author points out the inconsistency 92 of the terminology of land and water legislation in determining the composition of water fund lands and analyzes the contradictions in legal regulation caused by this. It is proposed to clarify the types of land, land plots that correspond to the characteristics of the lands of the water fund taking into account additional criteria for their attribution. The author formulated scientific and practical conclusions on improving the composition of the water fund lands and the legal regulation of their use. |
