| Abstract: | Рассмотрено понятие таможенного союза в определении Генерального соглашения по тарифам и торговле, выделены положения Договора о Европейском экономическом сообществе, относящие к регулированию таможенного союза. Проанализировано место таможенного регулирования в рамках общей торговой политики Европейского союза. Значительное внимание уделено исследованию противоречий в вопросе о границах разграничения компетенции между Европейским Союзом и государствами — членами ЕС при реализации общей торговой политики и, соответственно, таможенного регулирования как ее части. При анализе указанных противоречий изучена практика Суда Европейского союза и отмечена его последовательная позиция в данном вопросе как в заключениях, так и в решениях по делам, которые он рассматривал |
| Abstract (in another language): | The concept of a customs union in the definition of the General Agreement on Tariff s and Trade is considered, the provisions of the Treaty on the European Economic Community, related to the regulation of the customs union, are highlighted. The place of customs regulation within the framework of the general trade policy of the European Union is analyzed. Considerable attention is paid to the study of contradictions in the issue of the boundaries of the delimitation of competence between the European Union and the EU Member States in the implementation of a common trade policy and, accordingly, customs regulation as part of it. When analyzing these contradictions, the practice of the Court of Justice of the European Union was studied and it’s consistent position on this issue was noted both in the conclusions and in the decisions on the cases that it considered |
