| Abstract: | На основе анализа норм гражданского законодательства о наследовании с учетом особенностей исчисления сроков в статье обоснована позиция о необходимости при применении положения о том, что срок, исчисляемый месяцами, истекает в соответствующее число последнего месяца срока, толковать термин «соответствующее число» применительно к моменту наступления события, послужившего основанием исчисления срока для принятия наследства — дню смерти наследодателя; сформулировано предложение о закреплении в законодательстве понятия «нерабочий день» и особенностей его применения в гражданских правоотношениях |
| Abstract (in another language): | Based on the analysis of the norms of civil legislation on inheritance, taking into account the peculiarities of calculating the time limits, the article substantiates the position on the need, when applying the provision that a period calculated in months expires on the corresponding day of the last month of the period, to interpret the term "corresponding date" in relation to the time of the occurrence of the event , which served as the basis for calculating the period for accepting the inheritance — the day of the death of the testator; a proposal was formulated to consolidate the concept of “non-working day” in the legislation and the peculiarities of its application in civil relations |
