| Abstract: | В статье рассматриваются теоретические и практические уголовно правовые проблемы, связанные с вопросами определения квалифицирующих признаков должностного лица, в том числе анализируются признаки должностного лица, проблемы квалификации преступлений по признаку должностного лица, рассматривается институт соучастия в привязке к понятию должностного лица. Рассматривается следственная и судебная практика, анализируются вопросы признания отдельных категорий работников должностными лицами, тенденции как к расширению, так 190 и к сужению круга лиц, признаваемых субъектами должностных преступлений. В ходе анализа дается разграничение организационно-распорядительным и административно-хозяйственным функциям должностного лица. |
| Abstract (in another language): | The article deals with theoretical and practical criminal law problems related to the issues of determining the qualifying characteristics of an official, including the analysis of the characteristics of an official, the problems of qualifying crimes on the basis of an official, the institution of complicity in relation to the concept of an official. The article examines the investigative and judicial practice, where there are many difficulties in solving the issues of recognizing certain categories of employees as officials, and there are trends both to expand and to narrow the circle of persons recognized as subjects of official crimes. In the course of the analysis, a distinction is made between the organizationaladministrative and administrative-economic functions of an official. |
