| Abstract: | В XIII—XVIII вв. во многих исторических областях Центральной и Восточной Европы распространилось немецкое средневековое право. Причинами послужили миграционные процессы и общеевропейский колонизационный процесс XI—XIII вв. Был выработан целый ряд приемов, облегчавших процесс переселения, освоения новых угодий и создания новых деревень и городов, формировались юридические механизмы колонизации: 1) локация и 2) предоставление колонистам немецкого права. Наряду с миграционными процессами и колонизацией в качестве еще одной причины распространения права средневековой Германии следует назвать заинтересованность принимающей стороны в переселенцах, стремление привлечь комфортными условиями проживания, в том числе и привычным для них немецким правом. |
| Abstract (in another language): | The German laws spread throughout Central and Eastern Europe from the 13th to the 18th century. One of the main reasons of the process of expansions of the German law system in the Central and Eastern Europe regions in the Medieval and Modern Times is the migration processes and pan European colonization in the 11th — 13th centuries. During the process of the colonization a number of ways and methods were developed to assist in resettlement of people, colonization of new lands and foundation of new villages and towns. In that period, some concrete juridical techniques of colonization were developed including: (1) locating and (2) the granting of the German laws to colonists. Another reason of the spread of medieval German law system was an expression of the local authorities to attract more settlers with the most comfortable conditions (e.g. a familiar legal system). |
