| Abstract: | У артыкуле разглядаецца развіццѐ інстытута ўсынаўлення ў Антычнасці і Сярэднявеччы. У Старажытным Рыме існавалі два асноўныя віды ўсынаўлення: adoptio і adrogatio. У часы Імперыі пачаўся працэс іх зліцця ў адзін, які канчаткова завяршыўся ў Візантыі. У сярэднявечнай Заходняй Еўропе падзел на adoptio і adrogatio фармальна захоўваўся, хоць адрозненні паміж імі, ў параўнанні са Старажытным Рымам, зрабіліся нязначнымі. У Старажытным Рыме інстытут усынаўлення юрыдычна замацоўваў пераход прыѐмнага сына або дачкі з-пад бацькоўскай улады (patria potestas) натуральнага бацькі пад уладу прыѐмнага бацькі. У Візантыі і ў сярэднявечнай Заходняй Еўропе ўсынаўленне стварала паміж усынавіцелем і ўсыноўленым асабістыя сувязі накшталт тых, якія існавалі паміж бацькам і ягонымі кроўнымі дзецьмі |
| Abstract (in another language): | The present article considers the development of the social institute of adoption during Antiquity and the Middle Ages. In Ancient Rome, there were two main types of adoption: adoptio and adrogatio. The merge of these two types into a single one begun in the Roman Empire and finally completed in the Byzantium, while in Western Europe the division into adoptio and adrogatio formally remained in force, although the differences between the two types were insignificant, when compared to Ancient Rome. In the Roman World adoption legally entrenched a transfer of an adopted child from his/her natural father‘s authority (patria potestas) under authority of an adopting father. In the Byzantine Empire as well as in Medieval Western Europe adoption established the personal ties, similar to those existing between natural parent and natural child, between adopter and adoptee |
