Abstract: The paper focuses on the confrontation between “the best interests of the child” standard and the methods of alternative dispute resolution (ADR) in the USA. America is a society with a substantial divorce rate. As a consequence, custody disputes are now the most common reason for a legal filing in the United States. The article reveals the role of the current US legal system in child custody arrangements and explains why the US legal system works that way. The best interests of the child principle as a dominant custody decision rule is explained. Due to the stated inadequacy of the best interest of the child principle proposals on how to encourage alternative dispute resolution are made
