| Abstract: | Исследуются особенности пенализации и депенализации в белорусской уголовно-правовой политике, рассматривается природа дифференциации уголовной наказуемости деяний в дискурсе плюрализма научных методологий. Раскрываются основания распределения наказуемости в уголовном законе. Обосновывается авторское видение системы критериев обусловленности дифференциации уголовной наказуемости деяний на основе аксиологической и антропологической методологии в сочетании с материалистическим и конструктивистским мировоззренческими подходами. Доказывается существование четырехуровневой системы дифференцирующих критериев оценки дозирования законодателем наказания в новом измерении значимости подвергаемых охране социальных ценностей и интересов. |
| Abstract (in another language): | The author examines the features of penalisation and depenalisation in the Belarusian criminal law policy, the author considers the nature of differentiation of criminal punishability of acts in the discourse of pluralism of scientific methodo logies. The grounds for the distribution of criminal punishability in the criminal law are revealed. The author’s vision of the system of criteria of conditionality of differentiation of criminal punishability of acts on the basis of axiological and anthropological methodology in combination with materialistic and constructivist worldview approaches is substantiated. The author proves the existence of a four-level system of differentiating criteria for evaluating the dosage of punishment by the legislator in a new dimension of the significance of social values and interests being protected. |
