| Abstract: | Анализируются правовые позиции Конституционного Суда Российской Федерации по вопросам генетической истории семьи и суррогатного материнства. Генетическая информация о человеке представляет собой особый вид персональных данных, требующий четкого и эффективного механизма правового регулирования, который обеспечил бы защиту такой информации от неправомерного сбора или использования. Авторами были сделаны выводы относительно сложившейся практики Конституционного Суда Российской Федерации в отмеченной области. |
| Abstract (in another language): | This article is devoted to a general analysis of the legal positions of the Constitutional Court of the Russian Federation on issues of the family genetic history and surrogacy. Genetic information about a person is a special type of personal data that requires a clear and effective legal regulation mechanism that would ensure the protection of such information from unlawful collection or use. The authors made conclusions regarding the current practice of the Constitutional Court of the Russian Federation in the noted area. |
