| Abstract: | В статье исследуется в сравнительно-правовом аспекте положения о субъектах семейных прав по законодательству Российской Федерации и Республики Беларусь. Автор заключил, что основные нормативные правовые акты РФ и Республики Беларусь о семье имеют множество недостатков в регламентации семейных отношений. С целью устранения несовершенства Семейного кодекса Российской Федерации и Кодекса о браке и семье Республики Беларусь обосновывается необходимость дополнения: общих положений: правилами о право- и дееспособности и в целом о семейно-правовом статусе; источниках семейного права; об объектах семейных прав, а также положениями устраняющими противоречия в принципах и обозначения субъектов; специальных положений: правилами о формах семейных отношений; о специфике осуществления, охраны и защиты семейных прав; о семейно-правовой ответственности; о родстве и свойстве и устанавливающими четкий правовой механизм регламентации отношений с иностранным участием, а также исключающих до объективно возможного применение гражданско-правовых конструкций к регламентации семейных отношений |
| Abstract (in another language): | The article examines in a comparative legal aspect the provisions on subjects of family rights under the laws of the Russian Federation and the Republic of Belarus. The author concluded that the basic regulatory legal acts of the Russian Federation and the Republic of Belarus on the family have many shortcomings in the regulation of family relations. In order to eliminate the imperfections of the Family Code of the Russian Federation and the Code on Marriage and the Family of the Republic of Belarus, the necessity of supplementing is justified: general provisions: rules on legal capacity and, in general, on family and legal status; sources of family law; on objects of family rights, as well as provisions eliminating contradictions in the principles and designations of subjects; special provisions - rules on forms of family relations; on the specifics of the implementation, protection and protection of family rights; on family legal responsibility; about kinship and property and establishing a clear legal mechanism for regulating relations with foreign participation, as well as excluding, to the objectively possible, application of civil law structures to regulate family relations |
