| Abstract: | Статья посвящена исследованию теоретических и практических аспектов уплаты неустойки за нарушение алиментной обязанности в контексте проблемы соотношения семейного и гражданского права. В рамках межотраслевого взаимодействия рассматриваются вопросы правовой природы неустойки за нарушение алиментной обязанности, возможности ее снижения, освобождения от уплаты, применения сроков исковой давности, соотношения неустойки и убытков. | Abstract (in another language): | The article is devoted to the study of theoretical and practical aspects of paying a penalty for violation of alimony obligations in the context of the problem of correlation between family and civil law. Within the framework of inter-industry interaction, the issues of the legal nature of the penalty for violation of alimony obligations, the possibility of its reduction, exemption from payment, the application of the Statute of limitations, the ratio of the penalty and losses are considered. Proposals for improving the legislation are formulated |
