| Abstract: | Уточняется понятие иерархии источников права посредством включения в его объём связей корреляции между общественными отношениями и отдельными видами и группами источников права. Выделяются и анализируются формы иерархических связей между основными и дополнительными источниками права. Проводится ранжирование источников права на основании содержания, формы и типа общественных отношений и глубинных социально-культурных факторов, которое позволяют точнее определить место источников права в национальной правовой системе. Юридическая значимость источников права раскрывается с помощью понятий юридического веса, межвидовой и внутривидовой юридической силы. Нормативное правовое закрепление системы и иерархии источников права предлагается осуществить в кодексе ”Об источниках права”. |
| Abstract (in another language): | The notion of hierarchy of sources of law is clarified by incorporating into it the volume of correlation links between social relations and individual types and groups of sources of law. Forms of hierarchical relationships between the main and additional sources of law are distinguished and studied. It is organized ranking of sources of law on the basis of content, form and the type of social relations and the deep socio – cultural factors that make it possible to define more precisely the place of sources of law in the national legal system. The legal significance of sources of law is revealed with the help of the concepts ‘legal weight’, interspecific and intraspecific ‘legal force’. Normative legal consolidation of the system and the hierarchy of sources of law is proposed to implement in the Code “On the sources of law”. |
