| Abstract: | The article deals with the analysis of the «offence » category and its expression in positive law by means of a non-phenomenological approach to the investigations of legal phenomena.The author comes to the conclusion about the necessity of drawing up the formulation of the content of the general theory of offence as an overbranch legal institution. = Анализируется категория «правонарушение», ее выражение в позитивном праве с помощью не феноменологического подхода к исследованиям явлений правовой действительности; делается вывод о необходимости разработки формулировки содержания общетеоретического правонарушения как над отраслевого правового института. |
