Abstract: | Current legal regulation of international freight forwarding has two significant features as follows: wide application of national law on the one hand and multiple non-normative instruments on the other. As a result it entails the necessity to establish applicable law in every practical case and to unify the law of transport forwarding in general. Solution of both issues deals with the question of criteria of international character qualification of freight forwarding. In the article the author analyses various doctrinal views on the subject under research, describes practice of international legal regulation in this sphere, proposes his own approach to the concept of "foreign element" in transport forwarding relations and makes an attempt to determine the scope of a draft convention on international freight forwarding. |
