Правовое регулирование служебной тайны в БССР в довоенный период (1919–1941)

Abstract

Исследуется одна из проблемных областей правового регулирования в Республике Беларусь – генезис служебной тайны как самостоятельного вида информации, распространение и (или) предоставление которой ограничено. Дается оценка уровню правовой регламентации служебной тайны в БССР в довоенный период (1919–1941). С учетом мнений исследователей, а также положений нормативных источников (конституции СССР, конституции и кодексы БССР, иные акты) проанализировано состояние правового обеспечения информации, составлявшей служебную тайну, рассмотрены особенности ее соотношения с иными правовыми режимами информации ограниченного доступа – государственной и коммерческой тайн). Обращено внимание на информационное содержание и субъектный состав служебной тайны в указанный период. Установлены положения правовых источников, регламентировавших правовой режим информации, составлявшей служебную тайну в БССР. = It is indicated by the author one of the problem areas of legal regulation of the relevant legal regime in the Republic of Belarus, it is the genesis of official secrecy, as an independent type of information, provision and (or) distribution of which is restricted. The purpose of research is study, evaluation and definition of the level of legal regulation of official secrecy in the Republic of Belarus in the Belarusian SSR in the pre-war period (1919–1941). Taking into account the views of researchers, as well as the provisions of the normative sources (USSR Constitutions, Constitutions and the codes of the Belarusian SSR, other acts), reviewed and analyzed the status of the legal provision of information, composing the official secrecy, particular qualities of its correlation with other legal regimes of restricted information (state secrecy, trade secrets). The attention was paid to the features of content and to the structure of subjects of official secrecy within the specified time period. The author identified and established the provisions of legal sources of which was regulated the legal regime of information, composing the official secrecy and other restricted information in the Belarusian SSR in the pre-war period.
