Abstract

The article analyzes the problem of the name and origin of the Kopny court in the Belarusian lands of the GDL on the basis of the study of written sources and literature. The author proposes the theory of the veche origin of kapa in conditions of neighborly and territorial solidarity among peasants. The author admits the possibility of the court being under a certain influence of the legal tradition and practice of the Russkaya Pravda times. = Анализируется проблема названия и происхождения копного суда на белорусских землях ВКЛ. Выдвигается авторская теория о вечевом происхождении копы при наличии соседско-территориальной солидарности в крестьянской среде, не исключая возможности определенного влияния на суд правовой традиции и практики времен Русской Правды.
