Формы и методы имплементации стандартов Совета Европы в национальное законодательство

Abstract

В статье раскрывается понятие стандартов Совета Европы, определяется их правовой статус и юридическая природа, исследуются механизм их имплементации в законодательство государств — членов Совета Европы, специфика применения в практике Конституционного Суда Республики Беларусь, формулируются рекомендации по приведению белорусского законодательства в соответствие с европейскими стандартами. = The article explores the notion of the Council of Europe standards, reveals their legal status and nature, investigates the mechanism of their implementation in the legislation of the Member States of the Council of Europe and the specifi c character of their application in the practice of the Constitutional Court of the Republic of Belarus. Recommendations are also made as to how Belarusian law can be brought into accordance with European standards.
