Принципы экологического права: к вопросу о разработке современных теоретико-правовых подходов

Abstract

The article investigates the theoretical bases of establishing the ecological law principles in the legislation of the Republic of Belarus. The analysis of general-theoretical views on the role and place of the principles in the law and norms of the legislation in environmental preservation shows the maintenance of the basic first principles of the environmental law and forms the directions of their development. The author makes a conclusion about the absence of a clear system of principles in the sources of the environmental law. Specific proposals on modification and additions to the legislation of the Republic of Belarus are formulated. = Исследуются теоретические основы установления в законодательстве Республики Беларусь принципов экологического права. Анализ общетеоретических взглядов на роль и место принципов в праве и норм законодательства об охране окружающей среды показывает содержание основных начал экологического права и формирует направления их развития. Делается вывод об отсутствии четкой системы принципов в источниках экологического права. Формулируются конкретные предложения по внесению изменений и дополнений в законодательство Республики Беларусь.
