Abstract

The article states the prognostic analysis of the influence on the criminal politics of the criminal responsibility system and the forms of its realization which have been worked out in the Republic of Belarus and consolidated in Criminal Code 1999. In the author's opinion, the strengthening of the resocializing influence on the criminal must be fulfilled not at the expense of broadening punitive characteristics of punishment and its forms, but by means of creative alternative to punishment measures of influence in accordance with the probation system within the framework of the institute of criminal responsibility. In this connection serious concern of effectiveness of using some forms of punishment is spoken out.
