Авторы: Schirinsky, O. Yu.
Аннотация: The standards of enforcement of arbitral awards arising from the New York сonvention of 1958 are examined, drawing on the example of Austria. Specifically, we review the process of enforcing awards of the International Arbitral Tribunal under the Belarusian Chamber of Commerce and Industry by an Austrian court of first instance. The aim was to develop a protocol of action for Belarusian lawyers to secure recognition and enforcement in Austria of awards of the International Arbitral Tribunal under the Belarusian Chamber of Commerce and Industry. We provide recommendations grounded in the results of our study.

Systemic interpretation of the American convention on human rights

Заглавие документа: Systemic interpretation of the American convention on human rights
Авторы: Fuentes, A.
Аннотация: This paper proposes a critical assessment of the jurisprudence of the InterAmerican Court of Human Rights (IACRTHR) regarding the systemic integration of the provisions enshrined in the American convention on human rights (ACHR), under the light of the developments of the corpus juris of international human rights law. By incorporating the evolution in the interpretation of human rights law into the reading of ACHR, IACRTHR has expanded the scope of protection of the rights recognized within the ACHR, aiming at delivering more effective and comprehensive protection of them. This study will specifically focus its analysis on the interpretative method applied by IACRTHR. In particular, special attention will be given to the manner that the regional tribunal has applied the method of systemic integration of international human rights law, under the guiding light of the pro homine principle, which hermeneutically put the protection of individuals at the centre of the interpretative process of international human rights law.

Аннотация: Safety evaluations made in the city Helsingborg indicate a decreased risk of being exposed to crime, but an increased feeling of unsafe. Damage in the form of scribbling (graffiti) is one of several indicators contributing to feeling unsafe. In this paper we investigate whether the use of Internetofthings technology, where a sensor monitors a walking and cycling tunnel, makes it possible to reduce scribbling. The study shows a number of interesting results. When the sensor was installed, the public showed a great and positive interest. A short time after installation, the sensor was subjected to a qua lified attack where heavy shocks were followed by an initiated way to determine if the sensor was damaged. A setting and tuning phase was used to empirically test different settings of the sensor to detect scribbling behavior. However, it became evident during the approximately 6month long measurement period that we received many false alarms, which were, for example, that people took shelter in the tunnel in the rain and stood or walked slowly when using their mobile phone. Du ring the measurement period, two scribbles occurred where the sensor detected one of them. We observe that the amount of scribbling has decreased significantly. The number of error reports on scribbling dropped from an average of 3.33 per month before the sensor was in place to 0.75 cases per month after the sensor was in place.
