Теоретико-правовая взаимосвязь понятий «народный суверенитет» и «демократия»

Abstract

Проводится теоретико-правовой анализ понятий «народный суверенитет» и «демократия», исследуется их содержание, рассматривается научное толкование и применение, их соотношение и взаимосвязь. Для определения состояния го су дар ственного суверенитета и суверенитета народа необходим политико-правовой ана лиз их детерминированности уровнем развития демократических институтов, взаимо-обу словленности состояния суверенитета народа и демократии, соотношения данных политико-правовых феноменов. Повышение уровня правового обеспечения государственного суверенитета Республики Беларусь непосредственно обусловлено состоянием суверенитета белорусского народа и демократии. Обосновывается теоретико-правовое отождествление понятий «народный суверенитет» и «демократия» в научной литературе, в связи с чем – целесообразность научно-практических исследований в области определения содержания этих понятий в их взаимосвязи = The article discusses the theoretical legal analysis of the terms «the sovereignty of the people» and «democracy», researches its intension, analyzes doctrinal interpretation and application, its correlation and interrelation. It is essential to make political and legal analysis of the determinacy of the state sovereignty and the sovereignty of the people by the development level of democratic institutions, interdependency of the status of the people’s sovereignty and democracy, correspondence between these political and legal phenomenon in order to determine the status of the state sovereignty and of the sovereignty of the people. The increase of the level of the legal groundwork for the state sovereignty of the Republic of Belarus directly attributable to the status of the sovereignty of Belarusian people and democracy. The article proves theoretical and legal equation of the terms «the sovereignty of people» and «democracy» in scientifical literature, therefore there are valid arguments for scientific and practical research in the area of the intension determination of the terms «the sovereignty of people» and «democracy» and its interrelation
